Policy is designed to ensure MailCompose remains a secure and suitable platform for all users. It outlines how our
Privacy Policy governs your use of MailCompose’s Services, detailing the types of information we process, the methods of
processing, and the reasons behind it.
MailCompose offers cloud-based transactional email services, and for U.S.-based customers, it also provides
transactional and/or marketing SMS services ("Services").
When it comes to the processing of information under EU data protection law, MailCompose acts as the Controller for our
customers' data. However, for the processing of Customer’s Data Subjects data under the same law, the Customer is the
Controller, and MailCompose acts as the Processor.
Consent
By accessing our Services, you agree to our Privacy Policy and Terms of Use (TOU), and you consent to the collection,
storage, use, and disclosure of your personal information as outlined in this Privacy Policy. Furthermore, by using our
Services, you accept the practices detailed in this Privacy Policy. Each time you visit our website or use the Service,
and whenever you voluntarily provide information to us, you consent to the collection, use, and disclosure of that
information, and you agree to receive emails or other forms of contact as described in this Privacy Policy. This Privacy
Policy applies to all users of our website and Services, regardless of whether you register or create an account with
us.
What information we Process
MailCompose collects both "Personal Data" and "Non-Personal Data" about you and will process this data for the duration
of the Services as described in the Terms of Use (TOU):
Personal Data:
1. Customer Information:
- Identification and contact details: legal name, contact information (e.g., email), representative's name.
- Billing details: billing address, PayPal account information, payment details.
- Organization information: name, address, geographic location, area of responsibility, VAT code, registration code.
- IT information: IP addresses, usage data, cookies, online navigation data, location data, browser information.
2. Data Subject Information:
- Information provided by the customer, including email addresses, IP addresses, location data, phone numbers, device
data, and any other information the customer provides to us.
You may log in at any time to update or delete this information. While you can choose not to provide certain Personal
Data, some information, such as an email address, is required for certain Services. If you choose not to provide
mandatory information, we may be unable to provide the requested service.
When providing SMS services, MailCompose utilizes a third-party SMS service provider, Bandwidth, to which we transfer
your data. You can review Bandwidth's Privacy Notice for more details.
Please note that MailCompose does not process or store your credit card information. Once you make a payment, your
credit card information is securely transferred to our third-party payment processor, Stripe. You can find Stripe’s
Privacy Policy for more information.
When you have sufficient credits, you can upload a list of your recipients' email addresses to MailCompose for email
verification. If you upload a list without verifying it, the list will be deleted from MailCompose. If the list is
verified, it will be stored in MailCompose, but you can delete it at any time.
Non-Personal Data:
1. Browser and Device Information:
- Details such as location, device type, model, number, browser type or operating system, time and date of access,
browsing activity, screen resolution, plug-ins, add-ons, and the version of the Services being used, along with other
non-identifying information.
2. Information from Your Use of the Services and Other Sources:
- We may collect data on how and when you use the Services, store it in log files, or other files linked to your
account, and connect it to other information we gather about you.
- We may also receive information from third-party sources such as public databases, social media platforms, third-party
data providers, and joint marketing partners. This may include details like time, date, browser used, demographic data,
device information (such as type, model, and IP address), location, online behavior data (such as use of social media
sites, page view data, and search results), actions taken, anonymous usage data, referring/exit pages and URLs, and
preferences submitted or generated based on your data and clicks.
Spam is any email you send to someone who has not given you their direct permission or when you do not have other legal
grounds to contact them on the topic of the email.
Purposes of collecting Data
MailCompose uses the information collected to operate and improve the Services, maintain service quality, provide
general usage statistics, promote and analyze the Services, offer customer support, and send information related to the
Services. We also use this information to protect the rights and safety of Customers, Data Subjects, third parties, and
ourselves. Additionally, it helps us send customized informational or promotional content, provide suggestions based on
marketing preferences, ensure compliance with our Terms of Use, meet legal requirements, verify identities and provided
information, manage payments, understand user demographics, interests, and needs, and analyze trends among users for
various business purposes.
We may combine Personal Data with other information we process to tailor informational content and enhance our ability
to provide Services according to marketing preferences and restrictions, for advertising or targeting purposes, or to
develop and offer more relevant products and features, all in accordance with this Privacy Policy.
Transferring to third-party companies
We will never sell, rent, or lease your Personal Data to any third party. However, we may share the information we
collect with third parties for the purposes outlined in this Privacy Policy. This includes sharing with third parties
that assist MailCompose in providing, enhancing, promoting, or supporting our Services, those that help with our
business operations, and those that perform services on our behalf—such as payment processors, hosting providers,
analytics services, content delivery networks, advertising partners, and others—in a manner consistent with this Privacy
Policy. We may also share information with third parties if it is required by law or in the event that you violate our
Terms of Use (TOU).
We may disclose Non-Personal Data for any purpose, as this type of information cannot be used to identify you or any
other person.
Safety of your information
MailCompose takes reasonable precautions, including technical and organizational security measures, to ensure a level of
security appropriate to the risk. We follow industry best practices to protect your Personal Data from unauthorized or
unlawful breaches that could lead to accidental or unlawful destruction, loss, alteration, unauthorized disclosure, or
access to Personal Data, thereby preserving the security and confidentiality of the data. However, these measures cannot
guarantee that your information will not be accessed, disclosed, altered, or destroyed due to a breach of these
precautions. By using our Services, you acknowledge that you understand and agree to assume these risks.
The Customer is responsible for reviewing the information provided by MailCompose about its data security and
independently determining whether the Services meet the Customer’s requirements and legal obligations under Data
Protection Laws. The Customer is also responsible for the secure use of the Services, which includes safeguarding their
account authentication credentials, protecting the security of Personal Data during transit to and from the Services,
and taking appropriate steps to securely encrypt or back up any Personal Data uploaded to the Services.
Data retention
Unless you specifically request the deletion of your Personal Data, we will retain it as long as necessary to fulfill
our Terms of Use (TOU), provide you with Services, and ensure the effective operation of our business. If you request
the deletion of your Personal Data, it will be processed within the next 30 days. After this 30-day period, the data
will be permanently deleted, with no option for recovery. If you wish to reverse the deletion within this 30-day period,
you must contact us directly with your request.
If you request the deletion of your Personal Data, we may still be required to retain certain personal records for
specific purposes: (i) to comply with legal obligations or regulations (such as keeping transaction records), (ii) to
address legal matters or defend against legal claims, and (iii) to prevent fraud or abuse on our Service. Consequently,
different types of Personal Data may be retained for varying lengths of time.
In some cases, we may be unable to immediately delete, anonymize, or obscure your Personal Data due to technical, legal,
or operational reasons. In such instances, we will take reasonable steps to securely isolate your Personal Data from
further processing until it can be properly deleted, anonymized, or de-identified.
If your account remains inactive for 6 months or longer, MailCompose reserves the right to permanently delete your
account and all associated data, including your templates, activity records, suppression lists, lists of recipient
emails, phone numbers (if SMS was sent), and your content such as emails or SMS. If MailCompose decides to delete your
account, you will be notified via email, giving you time to export your data or reactivate your account. Notifications
will be sent 30 days, 7 days, and 1 day before the permanent deletion of your data. Please note that once your data is
permanently deleted, it cannot be recovered.
Changes
MailCompose reserves the right to modify this Privacy Policy at any time. If we make changes to the Privacy Policy, we
will update this page to keep you informed about what information we collect, how we use it, and under what
circumstances we may disclose it. All changes will take effect immediately upon posting. We encourage you to review this
Privacy Policy periodically to stay informed about how your information is being used.
